How do bail bonds in Hays County work?

Bail bonds in Hays County run through one place: the Hays County Jail at 1307 Uhland Road in San Marcos. The person is booked there, a magistrate sets bail, and the bond is posted there. Texas law requires the person to be taken before a magistrate no later than 48 hours after the arrest.

The jail is the county’s, so the bond process is the same whether the arrest was in Kyle, Buda or Dripping Springs. What changes from town to town is who made the arrest and which court handles the smaller charges. The town pages below cover that.

Booking at the Hays County Jail

The jail is run by the Hays County Sheriff’s Office Corrections Bureau. Booking means a search, the arrest report, fingerprints and a photo. After that the person waits in a holding cell until a magistrate sees them.

These are the jail numbers families use most:

  • Corrections Bureau (the jail): 512-393-7800
  • Bond information: 512-393-7807 or 512-393-7690
  • Custody information line, 24 hours, English or Spanish: 866-268-8959

Our Hays County Jail inmate search guide shows how to look someone up on the county’s records portal. Once a person no longer shows on the jail roster, the county says they have been released.

The magistrate sets bail

Hays County’s Magistrate Court holds hearings seven days a week, 365 days a year. The magistrate tells the person what they are charged with and what their rights are, then sets bail and any conditions of release. The county notes that its magistrates do not decide guilt and cannot give legal advice.

Three ways bail gets posted

The jail accepts three kinds of bond. A cash bond is the full amount, paid to the county and returned after the person appears in court. With a surety bond, a fee is paid to a licensed bail bond company, and the company posts the full bond. A personal bond releases the person on their promise to appear, if the magistrate allows it. Our guide on how bail bonds work in Hays County explains each one in more detail.

The jail handles bonds in the order it receives them and says it cannot give a set release time. Jail staff are not allowed to recommend a bondsman.

Which court handles the case

Criminal cases from Hays County are heard at four levels of court, and the charge decides which one the case goes to.

  • District Courts hear felonies. Court dates come from the District Clerk at 512-393-7660.
  • County Courts at Law (there are three) hear Class A and Class B misdemeanors. Court dates come from the County Clerk at 512-393-7330.
  • Justice of the Peace courts hear misdemeanors punishable by a fine only. Hays County has seven: two in San Marcos, two in Kyle, and one each in Wimberley, Dripping Springs and Buda.
  • Municipal courts in cities that have them hear fine-only offenses inside the city limits, sharing that work with the local justice court under Texas law.

A justice of the peace can also act as a magistrate and set bonds. Which court a case lands in is shown on the bond paperwork or by the clerk. What the charge means for the person is a legal question a bail bond company cannot answer.
